Supreme Court Affirms Umo Eno As Akwa Ibom Governor

The Supreme Court has upheld the election victory of Umo Eno from the People’s Democratic Party (PDP) as the duly elected governor of Akwa Ibom State. The court dismissed the appeals by three parties challenging the outcome of the March 18, 2023, election.

The apex court panel, led by Justice Uwani Abba-Aji, rejected the appeals filed by the All-Progressives Congress (APC), the Young Progressives Party (YPP), and the Action Alliance (AC). The dismissal was based on the grounds of the non-qualification of the governor, who faced allegations of certificate forgery—allegations vehemently denied by the governor.

The Court of Appeal had previously affirmed the judgment dismissing a suit challenging the primary that selected Umo Eno as the PDP candidate for the state. The appellant, Okon, had sought the disqualification of Eno, claiming that he had forged a West African Examination Certificate (WAEC), which he submitted to the Independent National Electoral Commission (INEC) for the election.

The appellate court, however, dismissed the suit, deeming it lacking in merit, and imposed a fine of 15 million naira against the plaintiff. The judge determined that Okon's arguments were speculative and failed to substantiate the claim that Eno's certificates were forged. As a result, the Supreme Court, in its recent decision, affirmed Eno's election victory, ending the legal challenges the opposing parties posed.

Senate Confirms Nomination Of 11 Judges For Supreme Court

The Senate has confirmed the nomination of the 11 Justices of the Supreme Court, a sequel to the recommendation of the National Judicial Council (NJC) and President Bola Tinubu’s letter to the lawmakers seeking their confirmation.

The upper chamber confirmed them during plenary after a debate by the lawmakers who advocated for augmentation of the judiciary budget and stated the impropriety of leaving a vacuum in the Supreme Court for an extended period before making the appointments.

The nominees include Justice Haruna Tsammani (North-East), who chaired the 2023 Presidential Election Petition Court, Justice Moore Adumein (South-South), Justice Habeeb Abiru (South-West), Justice Jummai Sankey (North-Central), Justice Stephen Adah (North-Central).

On Wednesday, the Senate Committee on Judiciary, Human Rights, and Legal Matters screened all 11 nominees and brought the exercise report before the lawmakers.

Chairman of the Committee, Senator Tahir Munguno, and some other Senators spoke on the nomination of the justices.

The Senate President, Godswill Akpabio, later hoped their confirmation would justify their nomination.

With the confirmation of the 11 justices, the Supreme Court now has the complete statutory requirement of 21 justices on its bench.

The Supreme Court has rejected an application by Emeka Ihedioha of the People’s Democratic Party (PDP) in Imo State, seeking the issuance of a certificate of return as the rightful governor of Imo State, stating that Governor Hope Uzodinma was not qualified to run in the first place.

Justice Tijjani Abubakar, delivering the ruling on Tuesday, deemed the application lacking merit, describing it as unnecessary and irritating. Subsequently, the court awarded a cost of N40 million against Mike Ozekhome for bringing the matter before the court. The recipients of this cost include the Action People’s Party (APP), Uche Nnadi, Uche Nwosu, and the Independent National Electoral Commission (INEC).

Ozekhome's motion, considered frivolous by the court, sought a consequential order compelling INEC to issue a fresh Certificate of Return to Ihedioha, enabling him to serve a four-year tenure as Imo Governor. Ozekhome argued that Senator Hope Uzodimma unlawfully occupied the four years Ihedioha was supposed to serve.

In the motion, Ozekhome asserted that the All-Progressives Congress (APC) had no candidate in the 2019 Imo Governorship election, contending that Uzodimma should not have been governor on the APC platform. However, the Supreme Court dismissed the motion, citing a lack of jurisdiction to entertain such a request.

In the ruling, Justice Abubakar characterized the motion as strange, frivolous, baseless, unwarranted, and vexatious. He emphasized that the motion appeared to be a calculated attempt to mock the Supreme Court.

Old, New Naira Notes To Co-Exist Till Further Notice, Supreme Court Rules

In a recent development, the Supreme Court, in its Wednesday ruling, has decreed that the coexistence of the old N200, N500, and N1000 notes with their newer counterparts will persist until further notice.

The apex court, led by Justice Inyang Okoro, determined that both the outdated and modern notes shall retain their status as legal tender until the Federal Government establishes a comprehensive process for their replacement or redesign, following consultations with relevant stakeholders.

This decision stems from an application filed by the Federal Government seeking an extension of the time during which the old naira notes would remain legally acceptable. The government, represented by the Attorney-General of the Federation (AGF), Lateef Fagbemi, also requested the court to lift its earlier March 3 order, citing the inability to print a sufficient volume of new notes to facilitate the phasing out of the old currency by the initial December 31 deadline.

In the fresh application, the AGF elaborated on the necessity of extending the circulation period for the old notes. It emphasized that a refusal by the Supreme Court could potentially lead the country into another national, economic, and financial crisis, reminiscent of the challenges faced in the first quarter of the year during the implementation of the naira redesign policy under the former Central Bank of Nigeria (CBN) Governor, Godwin Emefiele.

The Federal Government argued that allowing the old notes to continue alongside the new ones until consultations with stakeholders take place is crucial to preventing a recurrence of economic turmoil. There are concerns that some Nigerians have already started hoarding both the old and new naira notes in anticipation of the December 31 deadline.

The unanimous decision of the seven-man panel was in favour of Fagbemi's application. Notably, in a mid-November announcement, the Central Bank of Nigeria (CBN) declared that the old N200, N500, and N1,000 notes would remain legal tender indefinitely.
