National Assembly To Pass 2023 Budget After Christmas

There are strong indications that the National Assembly will pass the 2023 Appropriation Bill next week.

President of the Senate, Ahmad Lawan, and Speaker of the House of Representatives, Femi Gbajabiamila, both indicated earlier this week that the Federal Government budget would be passed on Thursday, when lawmakers were scheduled to leave for the Christmas and New Year holidays.

Several lawmakers blamed the delay on the recent transmission of the 2022 Finance Bill and Supplementary Appropriation Bill to the National Assembly for consideration and passage.

The President, Major General Muhammadu Buhari (retd. ), only transmitted the Finance Bill on Wednesday, while the supplementary budget was received by the legislature on Thursday.

With the development, there is uncertainty about the continuation of the January-December budget cycle, which was restored three years ago by the current 9th National Assembly.

Following the National Assembly’s approval and transmission of the budget to the Executive, the relevant ministries, particularly the Ministry of Finance, Budget, and National Planning, usually scrutinize the content before the president signs it into law, a process that can take weeks.

Buhari Seeks NASS’ Approval For N819bn 2022 Supplementary Budget

President Muhammadu Buhari has transmitted a 2022 supplementary budget of 819 billion naira to the National Assembly.

In separate letters to the Senate President, Ahmad Lawan and the Speaker of the House of Representatives, Femi Gbajabiamila, the president sought the lawmakers’ approval of the budget.

He said all of the additional budget for 2022 are capital expenditure and it became necessary due to the devastation caused by floods on farmlands and road infrastructure.

He explained that in the year 2022, Nigeria witnessed the worst flood incidents in recent history, which has caused massive destruction of farmlands with risks of food insecurity.

Reading the letter on the floor of the senate, Senate President Ahmed Lawan further informed the lawmakers that the supplementary budget will be financed “through additional domestic borrowings.

Supreme Court Fixes May 19th For President Buhari’s Suit Against National Assembly Over Section 84(12) Of Electoral Act

The Supreme Court has invited President Muhammadu Buhari to appear before it on Thursday, May 19th for a hearing in a suit he instituted against the National Assembly challenging Section 84 subsection 12 of the 2022 Electoral Act.

Also invited to be in court on the same day are the National Assembly and its leadership to defend various constitutional breaches raised against them by the Presidency.

A hearing notice issued by the apex court indicated that the invitation of President Buhari was served on him through his private lawyer, Prince Lateef Fagbemi.

By implication, Fagbemi, a Senior Advocate of Nigeria, is to profer arguments against the National Assembly on the invalidity and unconstitutionality of Section 84 (12) of the new Electoral Act.

The National Assembly had countered a suit filed by President Buhari and the Attorney-General of the Federation and Minister of Justice, Abubakar Malami, on the controversial Section 84 subsection 12.

While the President and minister asked the Supreme Court to interpret the provision of the section of the law, the lawmakers opposed the request to strike it out.

Their position was contained in a counter-affidavit filed by the counsel to the National Assembly, Kayode Ajulo at the apex court.

Speaking on a monitored programme, a Senior Advocate of Nigeria, Jibrin Okutekpa wondered what the grievance of President Buhari was, considering that he is not affected by the said section of the act.
