Court Orders EFCC To Pay Emefiele N100m For Unlawful Detention

Justice Olukayode Adeniyi of a High Court of the Federal Capital Territory (FCT) has slammed a 100 million naira fine against the Federal Government and the Economic and Financial Crimes Commission (EFCC) for unlawfully detaining former Governor of the Central Bank of Nigeria (CBN), Godwin Emefiele.

Justice Adeniyi further barred the Federal Government and any of its agencies, notwithstanding Emefiele’s current trial, from re-arresting, detaining, and harassing him over any alleged offence without obtaining a warrant of arrest from a court of competent jurisdiction.

The judge issued the order after declaring Emefiele's long detention for over five months by the Department of State Service (DSS) and EFCC illegal, unlawful, and unconstitutional.

According to him, the excuse by the Federal Government that Emefiele was being investigated for other alleged infractions was not tenable, adding that the order of detention obtained from a Chief Magistrate Court in Wuse, Abuja, lacked probative value.

He further criticized security agencies for first arresting and detaining suspects before conducting an investigation.

Moreover, the EFCC has expressed dissatisfaction with the judgment and said it would approach the Court of Appeal to set it aside while noting that the judge failed to accept that the Commission held the former CBN boss to a valid court order.

Ex-CBN Governor Emefiele Freed From Kuje Prison

The formerly embattled Governor of the Central Bank of Nigeria, Mr Godwin Emefiele, has been released from Kuje prison, as confirmed by Umar Abubakar, the spokesman for the Nigerian Correctional Service (NCoS), on Saturday.

According to Abubakar, Emefiele regained his freedom on Friday after successfully meeting the conditions for his bail. The release follows a month after Justice Hamza Muazu, on November 22, 2023, granted Emefiele a N300 million bail, stipulating that his sureties must possess landed properties in the Maitama District of Abuja.

Justice Muazu had initially ordered Emefiele's remand in prison until the fulfilment of his bail conditions. The legal proceedings stemmed from Emefiele's arraignment in court by the Economic and Financial Crimes Commission (EFCC) and the Nigerian Federal Government, who accused him of involvement in an N1.2 billion procurement fraud.

Notably, news of Emefiele's release coincides with revelations of financial impropriety attributed to him, as outlined in the interim report of Jim Obazee, the special investigator conducting a probe into the Central Bank of Nigeria.

Court To Decide Emefiele’s Fundamental Rights Suit January 8

The Federal Capital Territory High Court will deliver judgment in enforcing a fundamental rights suit filed by a former Central Bank of Nigeria (CBN) governor, Godwin Emefiele, on January 8, 2024.

Following his prolonged detention, Emefiele had dragged the Federal Government, Attorney-General of the Federation, Chairman of the Economic and Financial Crimes Commission, and the Commission before the court to enforce his fundamental rights to life, personal liberty, fair hearing, and freedom of movement.

He also sought a declaration of the court that his continued detention by the agency of the first and second respondents since June 10, 2023, and subsequent transfer to the custody of the third and fourth respondents on October 26, 2023, without being arraigned in court is unlawful.

At the resumed hearing, counsel for Emefiele Mathew Burkaa (SAN) told the court that the former CBN Governor was detained for 151 days, contrary to the law.

Responding, counsel for the first and second respondents, Oyin Koleosho (SAN), urged the court to dismiss the suit for lacking merit.

Justice Olukayode Adeniyi, after listening to the counsel's arguments, fixed January 8 for judgment.

Court Adjourns Emefiele’s Case Till January 18

The Federal Capital Territory High Court has adjourned till January 18, 2024, to continue the trial in the alleged procurement fraud suit against former Central Bank Governor Godwin Emefiele.

Emefiele is accused of using his position to confer a corrupt advantage on a CBN staff member, Sa’adatu Yaro, by awarding a contract to procure 43 vehicles worth N1.2 billion between 2018 and 2020.

He pleaded not guilty to the charges and was remanded at the Kuje Correctional Center pending a ruling on his bail application last Wednesday.

Justice Hamza Muazu, however, granted Emefiele bail in the sum of N300 million. But he is yet to meet his bail conditions, as he was brought to court and taken away by armed personnel of the Nigerian Correctional Service.

At the resumed hearing, the prosecution witness, who is a top official of the Corporate Affairs Commission (CAC), told the court that Emefiele was not the owner or a shareholder of April 1616 Investment Limited, awarded a N1.2bn vehicle supply contract by CBN under his leadership.
