Court Stops DSS From Arresting Emefiele

A federal high court sitting in Abuja has declined an application by the Department of State Services (DSS) to arrest and detain the governor of the Central Bank of Nigeria (CBN), Godwin Emefiele.

In declining the motion ex parte — filed by an applicant in the absence of the respondent — the chief judge, Justice John Tsoho, said the secret police did not provide any concrete evidence to substantiate its claims that Emefiele was involved in terrorism financing and economic crimes.

The court said such an application should have been accompanied with the presidential approval because of the grave implications for the Nigerian economy if the CBN governor is arrested and detained.

There are suggestions that the bid to arrest Emefiele might be political given the impact the redesign of the naira and limit on cash withdrawals might have on vote-buying in the 2023 elections.

Earlier on Monday, a group of civil society organizations had raised the alarm that there was a plot to frame Emefiele for terrorism and remove him from office.

Meanwhile, DSS has warned Nigerians against being used to undermine its investigations.

In a statement, DSS spokesperson, Peter Afunanya, said the service will not be distracted by those seeking to use “propaganda” to undermine its lawful investigations.

Court Refuses Motion Seeking To Stop CBN’s New Cash Withdrawal Limits

Justice Chizoba Oriji of a High Court of the Federal Capital Territory (FCT) in Maitama has refused to grant a motion seeking to stop the new cash withdrawal limits of the Central Bank of Nigeria (CBN) which is expected to become effective next month.

The judge ordered the applicants to rather put all the defendants on notice and ordered accelerated hearing in the suit.

The ten applicants had on behalf of themselves and 20 million unbanked Nigerian citizens sued the President, the Attorney General of the Federation, the CBN and the Governor of the CBN, Godwin Emefiele, over the cash withdrawal limits and the redesign of the N1000, N500 and N200 banknotes.

The applicants prayed the Court to grant injunctions restraining the respondents from proceeding with the January 31, 2023 deadline to introduce the new notes.

They said this will protect the 20 million unbanked Nigerians who are vulnerable to information and the use of technologically driven platform without the possibility of financial inclusion.

They prayed for another injunction restraining the respondents from implementing the revised cash withdrawal policy, claiming that it is illegal.

Court Shifts Hearing In PDP’s Suit Against President Buhari On Electoral Act Till May 24th

The Federal High Court in Abuja has fixed 24th of May for a definite hearing in a suit instituted against President Muhammadu Buhari by the Peoples’ Democratic Party, on the controversial sections 84 subsections (11) and (12) of the Electoral Act 2022.

Justice Inyang Eden Ekwo fixed the new date to enable Buhari and PDP address him on the effect of the Court of Appeal’s judgment in Abuja which declared the contentious Section 84 (12) as unconstitutional, null and void.

The judge on his own raised the issue on the ground that the PDP’s suit bothers on the same section of the law in which a higher court had made a pronouncement that would bind a lower court.

Joseph Daudu, a Senior Advocate of Nigeria, in response made spirited attempts to draw a distinction between the two matters and why the judge should proceed to hear the PDP’s suit.

However, Oladipupo Okpeseyi disagreed with the PDP’s lawyer insisting that there was no difference between the Umuahia suit and that of PDP because the two are on the same Section 84 (12) of the Electoral Act.

Counsel to PDP, Daudu spoke with newsmen after the court’s hearing.

Court Convicts Evans, Two Others of Kidnapping Businessman Donatus Duru

A Lagos High Court in Ikeja has convicted kidnap kingpin, Chukwudumeme Onwuamadike popularly called Evans on a two-count of conspiracy and kidnapping of a businessman, Donatus Duru.

The victim is the Managing Director of Maydon Pharmaceuticals Ltd.

Justice Hakeem Oshodi on Friday convicted Evans alongside two of his co-defendants, Uchenna Amadi and Okuchuwkwu Nwachukwu.

The judge held that the prosecution had successfully proved the charge against the three convicts beyond a reasonable doubt.

In arriving at his verdict on Evans, the judge held that he observed the demeanour of the witness. stating that in some of the confessional videos played in court, Evans had mentioned some of the other defendants and the roles they played in the crime.

“He was seen freely laughing and willingly answered questions. A close look at his body shows no sign of torture. He did not look unkempt. He is seen laughing even when he was told that he must be a rich kidnapper,” Justice Oshodi said.

“He showed no remorse in the dock and tried to lie his way out of the crimes despite the video evidence.”

He concluded that the evidence tendered before the court especially their video confessions corroborated their guilt.

The court discharged and acquitted Ogechi Uchechukwu and two former soldiers of the Nigerian Army, Chilaka Ifeanyi and Victor Aduba for lack of sufficient evidence linking them to the crime.

The Lagos State government had arraigned Evans alongside Uche Amadi, Okwuchukwu Nwachukwu, Ogechi Uchechukwu, Chilaka Ifeanyi, and Victor Aduba for allegedly kidnapping the Managing Director of Maydon Pharmaceuticals Limited, Donatus Dunu February 14, 2017.
