Breach Of Contract: Court Dismisses Davido’s Preliminary Objection

The Delta State High Court in Effurun has rejected the preliminary objection raised by Nigerian-American singer David Adedeji Adeleke, also known as Davido, and his company, Davido Music Worldwide Limited. The objection challenged the court's jurisdiction in hearing the breach of contract lawsuit filed against them by Brownhill Investment Company Limited concerning the annual 'Warri Again Concert.'

Justice Nduka Obi, the trial judge, also dismissed another objection raised by Davido Music Worldwide and Israel Afeare, challenging the court's jurisdiction in the defamation case filed against them.

In the ruling for Suit No. EHC/183/2023 between Brownhill Investment Company Limited and Davido & Davido Music Worldwide Limited, related to breach of contract, the court dismissed the defendant's argument that the case was a debt recovery matter and premature since the claimant did not issue a letter of demand for a refund before filing the case. The court concurred with the claimant's counsel, stating that the reliefs sought in the writ of summons indicated a breach of contract action, not requiring a prior letter of demand.

Regarding the defamation case, the court affirmed that the High Court of Delta State had territorial jurisdiction to hear and determine both cases. This was based on evidence that the claimant, a resident of Delta State, was present in the state when the alleged defamatory publications were posted online by the defendants. The court adjourned to hear all the cases filed against the defendants.

Despite discussing a potential out-of-court settlement, the claimant highlighted that concrete arrangements were not made because the defendants insisted on unacceptable terms. Brownhill Investments Company Limited, through its lawyer Kelechi Onwuegbuchulem, had sought N2 billion in general damages against Davido in the lawsuit.

Visibly shaken, Abraham recounted how she discovered the movie on social media, causing her immense emotional turmoil. She said of the incident, "If you look at me, you will know that I am actually not okay. I had to come from the hospital. I have been having panic attacks. Shooting a movie close to N500 million is difficult, and you see it out there."

The actress described the surreal experience of finding her movie leaked alongside another, leading her to question whether she was dreaming. She expressed the emotional toll, stating, "I wanted to run mad; it was like my whole world was coming to an end in front of me."

Abraham shared her efforts to counteract the piracy, involving her manager, husband, and the Filmone team. Desperation led to contacting tech experts and contacting Google and Telegram to break the illicit links. She recounted, "I don’t know what to do; this is my life; this is the only thing I do. That is why I decided to take it upon myself, my manager, and Filmone to fight piracy."

The actress revealed her financial losses due to people opting to wait for the movie's free online release. Despite the setback, she emphasized her commitment to the cause, stating, "It is not about the money now. It is about fighting a particular cause for the entertainment and creative industry, which I am happy about."
