April 23, 2024 Bobrisky Files Notice Of Appeal, Challenges Conviction

Popularly known as Bobrisky, controversial cross-dresser and socialite Idris Olanrewaju Okuneye has taken legal action against his conviction on four counts of Naira abuse.

Bobrisky, represented by his lawyer Bimbo Kusanu, has lodged a notice of appeal seeking to overturn the six-month imprisonment sentence handed down by Justice Abimbola Awogboro of the Federal High Court, Lagos. Instead, Bobrisky proposes substituting the imprisonment with a fine of N50,000 for each count.

Bobrisky's appeal contends that the trial court's decision was unduly harsh, particularly considering his lack of prior criminal convictions and the possibility for a more lenient sentence under the Administration of Criminal Justice Act (ACJA). He emphasizes his cooperation with the Economic and Financial Crimes Commission (EFCC) during the investigation and his guilty plea as positive factors that were not adequately considered in the sentencing.

Critically, Bobrisky challenges the rationale behind the maximum penalty, arguing that it does not align with the intention of the Central Bank Act of 2007, which aims to deter Nigerians from tampering with the Naira. He asserts that the court's emphasis on foreign perceptions of Naira abuse is misplaced. Ultimately, Bobrisky urges the court to reconsider the sentence, arguing that the imposition of imprisonment without an option of fine constitutes a miscarriage of justice.
