AGF Warns Council Officials: Jail Awaits Those Who Misuse LG Funds

The Attorney General of the Federation (AGF) and Minister of Justice, Lateef Fagbemi, has issued a stern warning against violating the Supreme Court’s ruling on local government autonomy, pledging to take decisive action against offending council officials. Fagbemi made this declaration during a conference for judiciary correspondents held on Thursday in Abuja.

According to the AGF, grassroots governance has endured significant setbacks over the years. However, he expressed optimism that the enforcement of the Supreme Court’s verdict on local government autonomy would rejuvenate the sector. He emphasized the need to restore vitality to local governments, enabling them to serve their intended purpose effectively.

Highlighting the negligence faced by people at the grassroots level, Fagbemi stressed that the administration of President Ahmed Bola Tinubu is determined to rectify past injustices and elevate the country’s standing globally. He cautioned local government officials against mismanaging funds, reminding them that they do not enjoy the immunity granted to governors.

Fagbemi stated that local government officials have a clear choice: misuse public funds and face imprisonment, or contribute meaningfully to grassroots development by investing in essential projects like roads, schools, and hospitals. He underscored the necessity of revitalizing local governments to ensure improved living conditions for citizens.

In a landmark judgment delivered in July, the Supreme Court reaffirmed the financial autonomy of local governments, putting an end to the practice of governors controlling local government funds. The ruling also directed the AGF to ensure that local government allocations are paid directly into their accounts, a move designed to strengthen autonomy and promote accountability across the country.

Additionally, the Senate summoned the Managing Director of Julius Berger Nigeria PLC for failing to respond to invitations to clarify the company’s involvement in the Odukpani-Itu Highway project. The highway, which spans Cross River and Akwa Ibom states, is a vital transportation and economic link for the south-south region.

Senator Osita Ngwu, who sponsored the motion, alleged that Julius Berger has repeatedly ignored invitations despite receiving over N18 billion in public funds for the project.

The Senate condemned the company’s actions, emphasizing that disregarding lawful invitations undermines the constitutional authority of the National Assembly and constitutes contempt.

Senate Issues Arrest Warrant for Julius Berger Over Ignored Invitations

The Nigerian Senate has issued a warrant of arrest against the management of Julius Berger, a construction company, for repeatedly ignoring invitations to appear before its Committee on Works.

The decision was made on Thursday after Senator Osita Ngwu, representing Enugu West, raised a motion highlighting the company's consistent failure to honor Senate invitations. Ngwu expressed concern over numerous incomplete and failed contracts associated with Julius Berger across the country, emphasizing the need for an investigation. He accused the company of disregarding the authority of the Senate.

Ngwu referenced the Senate’s constitutional powers to summon individuals or entities for hearings, stating, "If a committee summons any person or entity to come for a committee hearing and that entity does not send a representative or appear in any way, the normal procedure is to report to the presiding officer, who then issues a warrant."

He called on Senate President Godswill Akpabio to enforce compliance and compel Julius Berger to appear. Senator Abdul Ningi, representing Bauchi Central, supported the motion, citing constitutional provisions and Senate rules that empower the presiding officer to issue warrants of arrest in such cases.

Ningi explained that committees operate under these powers, but the authority to compel attendance rests with the presiding officer and requires the Senate’s collective mandate.

While Senator Adams Oshiomhole expressed a differing view, Senate President Akpabio affirmed the Senate's authority to issue the arrest warrant. He referenced relevant sections of the Constitution and Senate rules to justify the action, ensuring Julius Berger’s management would be compelled to address the Senate’s concerns.
