Court Rules Declaring Emefiele’s Wife Wanted is Illegal

A Federal High Court in Lagos has ruled that the Economic and Financial Crimes Commission (EFCC) acted illegally in declaring Margaret Emefiele, wife of the former Central Bank of Nigeria (CBN) Governor Godwin Emefiele, a wanted person. Justice Deinde Dipeolu issued this ruling in response to a fundamental rights application filed by Mrs. Emefiele. The court ordered the EFCC to pay her ₦3 million in damages for infringing on her rights.

Mrs. Emefiele had taken legal action against the EFCC and its chairman for declaring her wanted and posting her photographs on their website without a valid court order. She argued that this action violated her fundamental human rights. In her suit, she requested the court to declare the EFCC’s actions illegal, remove her name and photograph from the wanted persons list on their website, and issue a public apology through two national television stations and three newspapers.

Justice Dipeolu's judgment, delivered last Friday, affirmed that the EFCC's publication of Mrs. Emefiele's name and photograph as a wanted person was illegal due to non-compliance with Sections 41 and 42 of the Administration of Criminal Justice Act (ACJA) 2015, and the absence of a valid charge or court order.

After considering the arguments from both the applicant and the EFCC's legal team, Justice Dipeolu ruled in favor of Mrs. Emefiele. He stated that the publication violated her fundamental rights to dignity, personal liberty, freedom of movement, and security as guaranteed by the Nigerian Constitution and the African Charter on Human and Peoples’ Rights. The court directed the EFCC to immediately remove her name and photographs from their wanted persons list and issue a public apology on their website. Additionally, the court awarded ₦3 million in damages to Mrs. Emefiele for the violation of her fundamental rights.

A Federal High Court in Abuja has dismissed a ₦1 billion lawsuit filed by Nnamdi Kanu, the detained leader of the proscribed Indigenous People of Biafra (IPOB), against the Federal Government and the Department of State Services (DSS). Justice James Omotosho delivered the judgment, stating that Kanu did not provide credible evidence to support his claims of rights violations by the defendants.

The court ruled against Kanu's allegations that he was denied unrestricted access to his lawyers by DSS operatives and that his conversations with legal counsel were eavesdropped upon. Justice Omotosho concluded that these claims could not be substantiated.

NAN reported that Kanu, through his lawyer Aloy Ejimakor, had filed the lawsuit against the Federal Republic of Nigeria, the Attorney-General of the Federation, the DSS, and its Director-General. The lawsuit sought various declarations and injunctions, including recognition that the seizure and photocopying of confidential legal documents by the DSS constituted a breach of his rights.

In response, the DSS filed a counter affidavit denying the allegations. Yamuje Benye, a staff member of the DSS Legal Department, asserted that Kanu was securely held and not in solitary confinement. Benye stated that Kanu had regular access to his family and legal team during visiting hours without interference.

Benye refuted claims of document confiscation or interference with legal consultations, stating that DSS personnel adhered to standard security procedures during visits. He argued that Kanu's lawsuit amounted to an abuse of the court process, as similar issues were pending judgment before another court presided over by Justice Binta Nyako.

The Federal Republic of Nigeria and the Attorney-General of the Federation also supported the dismissal of the lawsuit, citing it as an abuse of court process.

According to presidential spokesman Ajuri Ngelale, Tinubu expressed his commitment to providing necessary support to alleviate the hardship faced by Nigerians.

"President Bola Tinubu has approved the immediate rollout of the National Construction and Household Support Programme to cover all geo-political zones in the country," the statement read. "As part of this program, ₦155 billion will be allocated for the purchase and distribution of assorted foodstuffs nationwide."

Additionally, Tinubu approved a ₦50,000 uplift grant for 100,000 families per state for three months. He stressed the importance of enhancing food production, noting the critical role of the Sokoto-Badagry Highway, which connects key agricultural regions and facilitates food export.

"Our states must collaborate to implement the essential reforms needed to meet the needs of our people. Time is a precious asset, and we must act swiftly," Tinubu said. "We are ready to support agricultural mechanization, provide high-quality seedlings, and install solar-powered irrigation facilities for year-round farming. Our goal is to produce sufficient food for our people and create jobs in the process."

Tinubu emphasized the need for coordination among NEC members to achieve these objectives. He invited governors to specify the support they need and to report back within seven days. "We must deliver on our targets at all levels to ensure food security and economic growth for Nigerians," he concluded.

Former NIPOST CEO Bisi Adegbuyi has emphasized the need to remove any National Identification Number (NIN) from Nigeria’s identification database that lacks a physically verifiable address. In an interview on Thursday, Adegbuyi stressed that protecting Nigerians' data and addressing potential compromises necessitate this measure.

He commended Nigeria’s recent memorandum of understanding with the Modular Open-Source Identity Platform (MOSIP) but warned that without robust address verification, the initiative could fail. "Before integrating data, a multi-stakeholder approach is essential. We must clean up the NIMC identity ecosystem and ensure it is address-based. Any NIN not linked to a verifiable address should be removed from the database," he said.

Adegbuyi referenced a meeting between Bill Gates and the Nigerian President at the World Economic Forum, where Gates criticized Nigeria's fragmented identity system. Gates advocated for adopting MOSIP, inspired by India's successful Aadhaar system, which is the world’s largest end-to-end identity system.

However, Adegbuyi cautioned that merely adopting MOSIP without establishing physically verifiable addresses would be ineffective. He called for a "stress test" of the NIMC identity ecosystem, ensuring all linked addresses are verified by their coordinates.

He shared his vision of providing 102 billion three-meter by three-meter grid digital addresses to Nigerians, a project hindered by bureaucratic challenges during his tenure. Adegbuyi highlighted Nigeria's potential as a significant e-commerce market, emphasizing the importance of accurate address verification.

He also underscored the need for collaboration between NIMC and NIPOST, suggesting NIMC handle identity numbers while NIPOST manages digital address verification. "NIPOST is a crucial national infrastructure for the last mile. There must be synergy between NIMC and NIPOST. It's not rocket science. With MOSIP's technology and a comparative analysis of other identity systems, we can achieve this. I have the necessary technology—Agile, scalable, with a full application program interface," Adegbuyi concluded, emphasizing the importance of leveraging his international exposure and experience for Nigeria's benefit.
