Deliver Judgement Without Fear, LP Tells Presidential Tribunal

The long-awaited verdict of the Presidential Election Petitions Court is set to be delivered in some hours.

The Lagos State Chapter of the Labour Party has urged the judges sitting at the Presidential Election Petition Tribunal in Abuja to deliver judgment with utmost fairness as they set to deliver judgment today, Wednesday, September 6, 2023.

The judgment will be delivered by the tribunal's Chairman, Justice Haruna Tsammani, assisted by other members of the panel-Justices Stephen Adah, Monsurat Bolaji-Yusuf, Moses Ugo, and Abba Mohammed.

The proceedings will be held at the Court of Appeal, Three Arms zone in Abuja.

The Chairman of the Independent National Electoral Commission, Prof Mahmood Yakubu, had on the first of March declared Bola Tinubu of the All-Progressives Congress as the president-elect after polling 8.8 million to defeat the PDP standard bearer, Atiku Abubakar, who scored 6.9 million, the LP candidate, Peter Obi, who polled 6.1 million and 15 other candidates.

The Court of Appeal Headquarters in Abuja is brimming with a robust security presence as the Presidential Election Petition Court (PEPC) readies itself to pronounce judgment on three petitions seeking to unseat President Bola Tinubu from office.

Security personnel, armed to the teeth and representing the Nigeria Army, Nigeria Police Force (NPF), and the Nigeria Civil Defence and Security Corps (NSCDC), have been strategically positioned at all entrances to the court. Meanwhile, armed with extensive lists, the Department of State Services (DSS) personnel meticulously verify the identities of all individuals entering the premises.

The court has warned that only accredited individuals will be granted access, even instructing its staff to remain home. However, it has announced its intention to allow a live broadcast of the judgment on the three petitions.

The five-member panel, led by Justice Haruna Tsammani, had given the green light for judgment on August 1 after all parties had presented their final briefs of argument.

The three petitions, identified as CA/PEPC/03/2023, CA/PEPC/05/2023, and CA/PEPC/04/2023, were filed by Mr Peter Obi of the Labour Party (LP), former Vice President and People’s Democratic Party (PDP) candidate Alhaji Atiku Abubakar, and the Allied Peoples Movement (APM), respectively.

On March 1, the Independent National Electoral Commission (INEC) declared President Tinubu, the candidate of the ruling All Progressives Congress (APC), as the winner of the presidential election held on February 25. He secured a total of 8,794,726 votes, defeating his two major rivals - Alhaji Atiku of the PDP, who came in second with 6,984,520 votes, and Mr Obi of the LP, who placed third with 6,101,533 votes.

Dissatisfied with the election outcome, Atiku and Obi approached the court to challenge the validity of the election results. In their separate petitions, they claimed victory in the presidential poll and contested President Tinubu's eligibility to contest the election. Additionally, they are seeking the withdrawal of the Certificate of Return issued to him by INEC.

The police urged Nigerians to embrace peace and maintain calm, regardless of their political affiliations.

Ahead of Wednesday’s judgment to be delivered by the Presidential Election Petition Court, the Nigeria Police Force has said that policemen nationwide are “fully prepared” to maintain law and order.

In a statement on Tuesday by Force Public Relations Officer (FPRO) Muyiwa Adejobi, the police warned politicians and mischief makers against misinformation and unguided utterances capable of inciting violence.

The police said deployment across the length and breadth of Nigeria has been strengthened to forestall law and order in the country.

“The Police wish to reiterate the commitment to ensuring the safety of lives and property before, during, and after the judgment,” Adejobi said.

“The NPF has diligently emplaced all necessary deployments and security measures during this critical period as officers and men are fully prepared to maintain order and enforce laws while respecting the rights and freedoms of all citizens.”

The police “strongly cautions all individuals, including mischief makers and political gladiators, to be cautious in their actions and statements as the Force will not condone activities capable of inciting violence or causing a descent into anarchy”.

The police urged citizens to embrace peace and maintain calm, regardless of their political affiliations.

Primate Ayodele Urges Nigerians To Lower Expectations Ahead Of Presidential Tribunal

In a recent statement, Primate Elijah Ayodele, the leader of INRI Evangelical Spiritual Church, advised Nigerians to temper their expectations regarding the forthcoming verdict from the Presidential Election Petition Tribunal, scheduled for Wednesday.

Speaking through his media aide, Oluwatosin Osho, Ayodele expressed his belief that the Labour Party (LP) presidential candidate, Peter Obi, would not emerge victorious at the tribunal.

He also issued a strong call for those who may not achieve a favourable outcome in the case to maintain law and order, stressing the importance of avoiding unnecessary unrest and chaos in the country. Ayodele emphasised, "The judgment will not go as Peter Obi and his followers want it. He can’t claim any victory through the tribunal, and just as I have said, the worst that can happen is a rerun of the election, or it will remain the way it is. No matter the outcome, losers should maintain law and order; they shouldn’t throw the country into riot because they lost the case."

Ayodele acknowledged the uncertain nature of the situation, suggesting that a rerun of the election might not be certain. Still, he also believed that God had the power to influence events. He cautioned that most Nigerians might not be satisfied with the tribunal's decision due to the powers' reluctance to let justice prevail. He asserted, "They still want to retain power no matter what it takes; it won’t be an easy journey to overturn the outcome of the presidential election. I have said that the court will not be able to sack Tinubu if the opposition allows him to win the election."

The prophet also called upon the judges to uphold justice and safeguard the country's unity, regardless of any intimidation they might encounter. He recognised the current tension in the country. He underscored the pivotal role the judges would play in determining the nation's future, stating, "The judges can either make or mar the country with their judgments. There is tension in the country already, and the best they can do is to ensure justice prevails at all costs without regard for the several forms of intimidation. They should be responsible for delivering judgments regarding the case.
