Appeal Court Nullifies Rivers 2024 Budget Passed by Edison-Ehie Faction

The Court of Appeal in Abuja has upheld the decision of the Federal High Court to nullify the ₦800 billion budget passed by five members of the Rivers State House of Assembly, led by Edison Ehie. The ruling came on Thursday as the court dismissed the appeal filed by Rivers State Governor Siminalayi Fubara, stating that the appeal lacked merit.

The appellate court noted that Governor Fubara had withdrawn his counter-affidavit in the lower court and, therefore, could not pursue an appeal on a matter he did not contest during the trial. The court emphasized that the governor must uphold the rule of law rather than exercise power arbitrarily.

Additionally, the court criticized the situation in the Rivers State House of Assembly, referring to it as an example of "executive dictatorship" by the governor and labeling the actions taken as a "joke taken too far."

The Minister of State for Petroleum Resources, Heineken Lokpobiri, has clarified that he did not instruct the Nigerian National Petroleum Company Limited (NNPCL) to cease operations at its refineries.

This statement comes after reports emerged from an event in Lagos, where Engr. Kamoru Busari, the Director of Upstream in the Ministry of Petroleum Resources, suggested that Lokpobiri had directed NNPCL to concentrate on equity participation in other refineries.

Lokpobiri stated, “I have been made aware of comments made by Engr. Kamoru Busari, who represented me at a recent conference in Lagos. I want to categorically clarify that the assertion that I directed NNPCL to stop operating its own refineries and focus solely on equity participation in other refineries is false. This does not reflect my position as the Minister overseeing the oil sector or the Federal Government's stance."

He further emphasized that NNPCL operates under the Companies and Allied Matters Act (CAMA), with its own functional board and management. The Ministry of Petroleum Resources does not control or manage NNPCL, which functions independently like any corporate entity.

“The oil and gas sector is fully deregulated, and the Nigerian government is committed to promoting domestic refining. We encourage companies, including NNPCL, to operate independently and adhere to global best practices. While we provide strategic guidance, we do not directly interfere in the operations of these companies,” he added.

Lokpobiri reaffirmed his commitment to supporting the growth and independence of NNPCL, ensuring that its operations align with international standards for efficiency, transparency, and profitability.

Wike Accuses Fubara of Backing APP in Rivers Local Government Elections

Former Rivers State Governor Nyesom Wike has accused his successor, Siminalayi Fubara, of backing the Action Peoples Party (APP) in the recently concluded local government elections. In the election, APP secured 22 out of 23 chairmanship positions, and days later, Governor Fubara swore in the new chairpersons. Bala Mohammed, the Chairman of the People’s Democratic Party (PDP) Governors’ Forum and Governor of Bauchi State, was also present at the ceremony.

Although Fubara is a member of the PDP, he had earlier stated that he was the "greatest loser" because his party did not participate in the election.

However, Wike, now Minister of the Federal Capital Territory (FCT), claims that Fubara was behind the APP's participation in the election. He contrasted this with his own record, referring to criticism he faced for supporting President Bola Tinubu of the All-Progressives Congress (APC) in the 2023 election.

"People say, ‘Discipline Wike; he did anti-party’. I did not do anti-party; I stood for equity, fairness, and justice,” Wike said. “But now, the governor [Fubara] is the one who sponsored the APP, and the Chairman of the [PDP] Governors' Forum was at the swearing-in.

Rivers Crisis: Wike Urges Fubara to ‘Obey Court Judgment for Peace’

Former Rivers State Governor Nyesom Wike has called on his successor, Siminalayi Fubara, to respect the rule of law to restore peace in the state. Wike made the remarks on Tuesday during a televised interview.

There is peace when you obey the rule of law. There is peace when you obey court judgments,” said Wike, who currently serves as Minister of the Federal Capital Territory (FCT).

His comments follow the escalating tensions in Rivers State, fueled by a growing feud between Wike and Fubara. The conflict recently intensified around the local government elections in the state.

A court ruling had ordered the police and the Department of State Services (DSS) not to provide security for the elections and directed the Independent National Electoral Commission (INEC) to withhold the voter register from the Rivers State Independent Electoral Commission (RSIEC). Despite this, the Fubara administration proceeded with the elections last Saturday.

Following the elections, the newly elected chairpersons and councillors were sworn in on Monday, sparking a fresh wave of violence. Three local government secretariats were torched and properties were destroyed.

Fubara has since pledged to identify and bring the perpetrators to justice, setting up a panel on Tuesday to investigate the attacks.

However, Wike maintained that the path to peace lies in upholding the court's ruling. “Obey the court judgment, and let the rule of law prevail. Ignoring the law leads to anarchy,” he warned.

Reflecting on his own tenure as governor, Wike emphasized the importance of respecting legal rulings. “I always obeyed the rule of law. Once you disregard court judgments, you invite chaos and violence,” he added.
