Senate Swears In Yohanna As Abbo’s Replacement

On Wednesday, the Senate administered the oath of office to Amos Yohanna, the new Senator representing Adamawa North Senatorial District. Deputy Senate President Jibrin Barau, who presided over the session, conducted the swearing-in ceremony.

Yohanna, a member of the People's Democratic Party (PDP), assumes the position, succeeding Abbo, who was removed by the Appeal Court the previous week. Abbo was a member of the All-Progressives Congress (APC).

The Court of Appeal in Abuja delivered the judgment, which compelled Abbo's removal. A three-member panel, with Justice C.E. Nwosu-Iheme presiding, directed the Independent National Electoral Commission (INEC) to issue a Certificate of Return to Yohanna as the duly elected representative of the Adamawa North Senatorial District in the National Assembly.

This ruling overturned the earlier decision by the tribunal, which had upheld Abbo's victory as the senatorial election winner. INEC had initially declared Abbo the winner of the parliamentary election held on February 25, 2023. Discontented with this outcome, the PDP and Yohanna had lodged a petition with the tribunal to challenge the results.

The tribunal, however, had dismissed Yohanna's petition, finding it lacking in merit. Unsatisfied with this verdict, the PDP candidate, represented by his counsel, Johnson Usman, SAN, took the case to the Appeal Court. The Court of Appeal, after hearing arguments from both sides, concurred with Usman's argument, citing Section 137 of the Electoral Act, 2022, to highlight a lack of compliance with the Electoral Act. Consequently, the court deducted the invalid votes from both parties and declared Yohanna and the PDP as the winners based on the majority of lawful votes.

Following this judgment, Senator Abbo expressed his discontent, labelling it a blow to democracy. However, he urged his supporters to remain calm.

INEC Removes APC’s Timipre Sylva From Bayelsa Election After Court Order

The Independent National Electoral Commission (INEC) has officially excluded Chief Timipre Sylva, the Governorship Candidate of the All-Progressives Congress (APC), and his deputy, Joshua Maciver, from the roster of eligible candidates for the forthcoming Governorship election in Bayelsa State.

This decision stems from a recent court directive mandating the removal of the APC candidates from the electoral race. In an official statement, INEC's Secretary, Rose Oriarian-Anthony, confirmed this development.

The Commission had initially unveiled the list of candidates for the Bayelsa State Governorship election on June 9, 2023, under the provisions of Section 32 of the Electoral Act, 2022 (as amended).

However, after the publication, INEC received a court order about the APC candidate's nomination for the 2023 governorship election in Bayelsa State. Oriarian-Anthony stated, "In light of the court order received after the publication of the candidates' list, the Independent National Electoral Commission is obligated to comply with the judicial directive."

The court order, leading to the exclusion of Chief Timipre Sylva and Joshua Maciver, was issued under the provisions of Section 287 of the Constitution of the Federal Republic of Nigeria, 1999 (as amended), which compels INEC to enforce court orders without exception.

Governor Adeleke, at 63 years of age, emphasized the importance of public servants making personal sacrifices in light of the state's challenging financial circumstances. The governor asserted, "Foreign trips for senior officials are hereby suspended for the remainder of the year, unless there is a genuine emergency situation that requires my authorization."

The meeting held on Monday was primarily focused on critical treasury board determinations that would impact the preparation of the 2024 budget. Deliberations revolved around budget proposals from various ministries, departments, and agencies, in anticipation of the submission of the Medium-Term Expenditure Framework to the State's House of Assembly.

Governor Adeleke underscored the importance of diligence in the entire process, stressing that the government should allocate funds exclusively for the execution of essential projects across the state. He emphasized, "We must maintain our commitment to efficient service delivery by avoiding unnecessary expenditures on recurrent and overhead costs."
