I’m Not Quitting Politics, Says Kaduna PDP Gov Candidate

The candidate of the Peoples’ Democratic Party in the March 18, 2023, governorship election in Kaduna State, Isa Ashiru, says he will not quit politics despite the Supreme Court’s verdict that affirmed the election of Governor Uba Sani.

Ashiru stated this at a media briefing in Kaduna following the Supreme Court’s judgment.

He also urged the governor to pilot the affairs of the state, saying he would accept a hand of fellowship if that is his wish.

It would be recalled that the Court of Appeal in Abuja had, on November 24, 2023, in a unanimous judgment, affirmed the election of Uba Sani as Kaduna State governor.

The PDP and Ashiru challenged the outcome of the governorship election, alleging that Uba was not duly elected by a majority of valid votes cast in the election.

The PDP governorship candidate said he had taken the Supreme Court’s verdict in good faith while maintaining that he never lost the 2023 governorship election in the state.

Ashiru equally noted that he would not quit the stage, noting that politics is not about him but about the good people of Kaduna State.

Rivers Crisis: Court Orders Parties To Maintain Status Quo

Justice Joyce Abdulmalik of the Federal High Court in Abuja has ordered all parties involved in the Rivers State Assembly crisis to maintain the status quo.

In a ruling delivered on Monday, Justice Abdulmalik instructed the parties not to take any further actions until the court determines an application seeking to prevent Governor Siminalayi Fubara from representing the already approved 2024 budget of the state before the legislative house.

The court has scheduled February 28 to hear the application, which was brought before it by six state elders. The plaintiffs, led by Hon. Victor Okon Jumbo, a member of the Rivers State House of Assembly representing Bonny State Constituency, include Senator Bennett Birabi, Senator Andrew Uchendu, Rear Admiral O.P. Fingesi, Ann Kio Briggs, and Emmanuel Deinma.

Through their legal representative, Olukayode Ajulo, the plaintiffs sought a declaration from the court to vacate the seats of 27 lawmakers in the state who defected from the People’s Democratic Party (PDP) to the All-Progressives Congress (APC). In a 19-paragraph affidavit, the court was informed that in November 2023, 27 out of 32 members of the Rivers State Assembly defected from the PDP without any lawful justification and began holding proceedings at a different location.

The plaintiffs asserted that the defected lawmakers are fully loyal to the former Governor of Rivers State, now Minister of F.C.T, Nyesom Wike, and disloyal to the current Governor, Mr. Siminilaya Fubara. They contended that only five members remained loyal to the PDP, questioning the constitutionality of a peace agreement allegedly forced by President Bola Tinubu between Governor Fubara and the former governor, Nyesom Wike.

The plaintiffs argued that the agreement, signed on December 18, 2023, was illegal and amounted to an usurpation, nullification, and undermining of the relevant provisions of the 1999 Constitution. They have asked the court to determine whether President Tinubu, Governor Fubara, and the Rivers State Assembly have the right to enter into an agreement that nullifies or undermines the constitutional provisions.

Additionally, they contested President Tinubu's and Governor Fubara's statutory powers to prevent the Independent National Electoral Commission (INEC) from conducting a fresh election to replace the defected lawmakers. In response to the case, Justice Abdulmalik ordered substituted service of court processes on the defendants, emphasising the need for them to be notified and allowed to respond to the plaintiffs' motion to halt the re-presentation of the Rivers State budget to the lawmakers who switched allegiance to the APC.

Court Nullifies N800bn Rivers Budget Passed By Pro-Fubara Lawmakers

The Federal High Court in Abuja, under the jurisdiction of Justice James, has declared the N800 billion budget passed by the Edison Ehie-led group of the Rivers State House of Assembly and signed into law by Governor Siminalayi Fubara as null and void.
The court also sided with the suit filed by the Assembly and Speaker Martin Amaewhule against Governor Fubara, seeking an injunction to prevent him from obstructing the Assembly's functions.
Amid the prolonged political crisis in the oil-rich state and the demolition of the Assembly Complex on December 13, 2023, Governor Fubara presented the 2024 budget proposal of N800 billion to a group of five Assembly members led by Edison Ehie at the Government House in Port Harcourt. This occurred after the state government demolished the Assembly Complex, and a court order prevented Ehie's contender, Martins Amaewhule, from using the Assembly Complex.
Despite the controversial circumstances, Ehie and other lawmakers supportive of Governor Fubara passed the budget, and it was signed into law by the governor. The budget was purportedly aimed at fostering economic development, inclusive growth, and addressing socio-economic inequality in the state.
Subsequently, Ehie resigned from the House, and Amaewhule was reinstated as the Assembly's Speaker after a meeting with President Bola Tinubu in Abuja. Amaewhule and 25 other lawmakers loyal to ex-Governor Nyesom Wike demanded that Governor Fubara present the 2024 budget estimates to the Assembly again, leading to a legal battle.
On Monday, Ken Njemanze, representing Amaewhule, accused the governor of interfering with the functions of state lawmakers, violating the separation of powers doctrine. The plaintiffs sought injunctions restraining the National Assembly from entertaining any request from Governor Fubara to take over the Assembly's functions and compelling the Inspector General of Police to provide security for the Assembly's Speaker.
Justice James Omotosho, presiding over the case, noted that Edison Ehie, the 17th defendant, claimed to have resigned from the Assembly, rendering him incapable of being a party. Justice Omotosho ruled that the suit was properly constituted despite the preliminary objection challenging the court's jurisdiction.
Disagreeing with the plaintiffs on the governor's powers, Justice Omotosho emphasised the shared powers of the executive, state Assembly, and local government areas in making laws. Regarding the National Assembly taking over the State Assembly's functions, the judge stated that such a move could only happen if the state lawmakers could not conduct their business, which was not the case.
Justice Omotosho declared the removal of the Clerk of the Rivers State House of Assembly, Emeka Amadi, null and void, emphasising that the Rivers State House of Assembly Law governs the appointment and remuneration of the Clerk and Deputy Clerk. The judge affirmed the Assembly's entitlement to funds and declared that the governor could not impede the release of funds standing to the credit of the Rivers Assembly in the state's Consolidated Revenue Fund, including salaries and emoluments.

The former Rivers State Governor claimed there are juicy opportunities in Nigeria that those seeking greener pastures in other countries may not have.
According to him, there are possibilities for someone to emerge suddenly as a leader in the country.
He said he has always discouraged those who want to leave the country, saying that if they want a 9 am to 5 pm job, they can always get that when they leave the country, but they can never get the opportunities that abound in Nigeria.
The former presidential aspirant also blamed the country’s economy for the ravaging crimes in Nigeria.
According to him, the Nigerian economy is too small and cannot accommodate everybody, leading to robbery and other crimes.
In an interview with Inspiration FM, Legal Practitioner and Public Affairs Analyst Fred Nzeako said the comment amounts to a mockery of Nigerians by the former Minister.
