Bayelsa Governorship: Sylva Files Appeal Against Disqualification

Just hours after the Federal High Court in Abuja disqualified him from contesting the upcoming gubernatorial election in Bayelsa State on November 11, the APC candidate, Timipre Sylva, has taken legal action by filing an appeal with the Court of Appeal, Abuja Division, requesting the annulment of the judgment.

In addition to the notice of appeal, Sylva, represented by his counsel, Ahmed Raji (SAN), has also requested a stay of execution of the High Court's decision. Raji emphasised that the High Court's judgment contradicts established legal principles and notable precedents.

The appeal revolves around three critical issues: jurisdiction, locus standi (the legal right to bring an action), and the alleged erroneous assessment of affidavit evidence.

Earlier, during a visit to the Presidential Villa, the APC National Chairman, Abdullahi Ganduje, confirmed the party's intent to challenge the judgment through an appeal.

The Federal High Court's Justice Donatus Okorowo ruled against the APC candidate's eligibility based on his previous two terms in office and five years of governance as the Governor of Bayelsa State. The court argued that his participation in another gubernatorial election would violate the 1999 Constitution, as amended.

A hearing date for the appeal is yet to be determined.

Senate Condemns N2.3tn Oil Theft, Probes Security Agents

In response to mounting concerns over the illicit activities of security forces and militia groups engaged in high-tech crude oil theft within the nation, the Senate has taken a significant step forward.

The decision came to fruition following a motion presented during a plenary session by Senator Ned Nwoko. In his statement, Senator Nwoko highlighted that pipeline vandalism and oil theft had inflicted a staggering N2.3 trillion in losses upon Nigeria this year alone.

Senator Adams Oshiomhole, echoing the sentiment, emphasised the endemic nature of this issue.

The initial voice on this critical matter was Senator Ned Nwoko, who brought it to the Senate's attention. He underscored the urgency of addressing the situation.

Senate President Godswill Akpabio, in his remarks, stressed the devastating impact of oil theft on the country's oil production capacity.

As a result, the Senate promptly instructed its pertinent committees, including Petroleum Resources (Upstream, Downstream, and Gas), Host Communities, and Niger Delta Affairs, to conduct an extensive investigation. The committees were tasked with delivering their findings and recommendations within six weeks.

Nigerian Major General Jailed For Stealing

A Nigerian Army Special Court-martial in Abuja found a former Group Managing Director of Nigerian Army Properties Limited (NAPL), Major General Umar Mohammed, guilty of stealing funds from the organisation.

General Mohammed was tried on an 18-count charge bordering on forgery, misappropriation of funds, and conspiracy. He had, however, earlier pleaded not guilty to all the charges.

But at the resumed sitting where the judgment was given, the eight-man panel led by Major General James Myam stated that the convicted senior military officer was found guilty of 14 out of 18 charges.

While explaining that the sentences would run concurrently, the court also directed that he should refund some funds into the account of NAPL.

Myam explained that the sentences are subject to the confirmation of “confirming authority”.

The Defence Counsel, Olalekan Ojo (SAN), spoke after the judgment.

Atiku Denies Forging His Waec Certificate

The Presidential Candidate of the Peoples’ Democratic Party (PDP), Atiku Abubakar, has explained the discrepancies in his Ordinary Level (O Level) Certificate.

In a post on his X platform, Atiku offered the clarification through one of his aides and former Presidential aspirants of the party, Dele Momodu.

According to Momodu, the clarification follows allegations of forgery against his principal by All-Progressives Congress (APC) members, who had questioned the name” Sadiq Abubakar” in Atiku’s WAEC certificate as against his other credentials.

Momodu said Atiku used Sadiq Abubakar to sit for WAEC, and after passing the exams, he swore to an affidavit that he was the same person as Atiku Abubakar.

He went further that the former Vice President attended Ahmadu Bello University as Atiku Abubakar, passed with the name, and got into the Customs Service as Atiku Abubakar.

However, the National Publicity Secretary of the APC, Felix Morka, faulted the result.
