OAGF Affirms Commitment to Court Orders Amid Rivers State Allocation Dispute

The Office of the Accountant-General of the Federation (OAGF) has reaffirmed its commitment to adhering to court rulings regarding federal allocations to Rivers State, amidst ongoing legal challenges over the state’s financial entitlements.

Speaking on Friday, OAGF Director of Press and Public Relations, Bawa Mokwa, stated, “We will obey the court order. Since there is a notice of appeal, it overrides the earlier judgment. If there is a notice of appeal, Rivers will be paid.”

This assurance follows an October 30, 2024, Federal High Court ruling that directed the Central Bank of Nigeria to suspend monthly allocations to Rivers State. The court declared the presentation of the 2024 budget by Governor Siminalayi Fubara to a four-member House of Assembly unconstitutional.

Justice Joyce Abdulmalik, in her ruling, described the state’s budget implementation since January 2024 as a “constitutional aberration” and deemed the decisions made by the four-member Assembly faction supporting Fubara void. She argued that such actions violated Sections 91 and 96 of the 1999 Constitution, which require budget approvals by a fully constituted legislative body.

The suit, filed by a faction of the State House of Assembly led by Martin Amaewhule, challenged the legitimacy of the Fubara-backed Assembly. Justice Abdulmalik dismissed attempts to stay the proceedings and denied requests for her recusal, labeling such applications “frivolous and vexatious.”

The Rivers State Government has since appealed the ruling. The state’s Commissioner for Information and Communications, Joseph Johnson, expressed confidence that the Court of Appeal would overturn the decision. He described the judgment as part of the ongoing political battle between Governor Fubara and the faction loyal to the Federal Capital Territory Minister, Nyesom Wike.

In light of the appeal, the OAGF confirmed that the appellate process supersedes the Federal High Court’s judgment, allowing federal allocations to Rivers State to continue pending the legal outcome.

The case has intensified the political crisis in Rivers State, with implications for governance and financial operations in the oil-rich region.

The Nigerian government has confirmed the suspension of the October Federation Account Allocation Committee (FAAC) revenue payment to Rivers State amid the ongoing conflict between Governor Simi Fubara and the Minister of the Federal Capital Territory, Nyesom Wike.

Bawa Mokwa, the spokesperson for the Office of the Accountant General of the Federation (OAGF), disclosed this on Friday, stating that the action follows a court order barring the disbursement.

The development comes after the Federal Government approved the disbursement of ₦1.1411 trillion for October 2024 FAAC revenue to the federal, state, and local governments. However, reports emerged that Rivers State's allocation was withheld due to a court injunction preventing the Central Bank of Nigeria (CBN) and the federal government from releasing the funds.

Mokwa confirmed the OAGF's compliance with the court order, noting that the disbursement process for other states was still ongoing. "The October 2024 FAAC has not yet been distributed. However, the Federal Government will obey the court order regarding Rivers State’s allocation unless a contrary order is issued," he said.

The legal injunction was issued on October 30 by Justice Abdulmalik of the Federal High Court. It stemmed from a case filed by a faction of the Rivers State House of Assembly led by Martin Amaewhule. The faction argued that the state executive, under Governor Fubara, failed to comply with a court directive to re-present the 2024 appropriation bill to the Amaewhule-led assembly faction.

The dispute is part of a broader political crisis in Rivers State, fueled by the fallout between Governor Fubara and his predecessor, Wike. This rift has led to significant unrest in the state, which is a key player in Nigeria’s oil sector.

The Supreme Court has invalidated the National Lottery Act of 2005, ruling that the National Assembly lacks the authority to legislate on matters related to lotteries and games of chance.

In a unanimous decision by a seven-member panel of justices, Justice Mohammed Idris delivered the lead judgment, stating that the jurisdiction over lotteries and games of chance resides exclusively with state Houses of Assembly. The court declared that the National Lottery Act 2005 could only be enforced within the Federal Capital Territory (FCT), where the National Assembly has legislative authority.

The legal challenge was initiated in 2008 by the Attorney General of Lagos State against the Federal Government over control and regulation of the gaming and lottery sectors. Ekiti State later joined as a co-plaintiff, following a court order in October 2020. Additionally, attorneys general from 34 other states were included as defendants by a Supreme Court order in November 2022.

The plaintiffs argued that lottery regulation does not fall under the 68 items listed in Part 1 of the Second Schedule of the 1999 Constitution, which grants the National Assembly exclusive legislative powers. They sought a declaration affirming that the National Assembly does not have the constitutional authority to enact laws regulating lotteries across the country.

This judgment reinforces the states' autonomy in managing gaming and lottery operations within their jurisdictions.
