Court Dismisses Lawsuit by Fleeing Anjarwalla Against NSA and EFCC

On Wednesday, a Federal High Court in Abuja dismissed a fundamental rights enforcement suit filed by Nadeem Anjarwalla, a fleeing executive of Binance Holdings Ltd, against the National Security Adviser (NSA) and the Economic and Financial Crimes Commission (EFCC). Justice Inyang Ekwo dismissed the suit due to a lack of diligent prosecution.

When the case was called, neither Anjarwalla nor his lawyer were present. Justice Ekwo noted that on March 28, Tonye Krukrubo, SAN, who represented Anjarwalla, had sought and was granted permission to withdraw from the case. The matter was then adjourned to today, but no lawyer appeared for Anjarwalla.

The News Agency of Nigeria (NAN) reported that Anjarwalla, Binance's Africa regional manager, had filed a separate suit along with his colleague, Tigran Gambaryan, against the NSA and EFCC, seeking their release from detention. However, Anjarwalla escaped custody on March 22 and fled to Kenya.

Anjarwalla and Gambaryan’s suits, marked FHC/ABJ/CS/355/24 and FHC/ABJ/CS/356/24 respectively, were filed before Justice Ekwo. They sued the Office of NSA (ONSA) and EFCC as respondents, seeking the same reliefs. They argued that their detention and the seizure of their passports violated their fundamental right to personal liberty as guaranteed by Section 35 (1) and (4) of the 1999 Constitution (as amended).

Justice Ekwo scheduled July 9 for the hearing of Gambaryan’s suit. This date was set after Gambaryan’s lawyer, Krukrubo, moved a motion to amend their originating process. Although EFCC’s lawyer, Olarewanju Adeola, opposed the motion, the judge granted the amendment, stating that parties are entitled to amend their processes before judgment.

However, Gambaryan was fined N50,000 in favor of the EFCC for joining issues in the matter. Justice Ekwo ordered that the fine must be paid before the next hearing, scheduled for July 9, where the preliminary objection and the substantive matter will be heard.

Fubara Orders Audit Of LG Accounts In Rivers

Governor Siminalayi Fubara of Rivers State has directed the state auditor general to audit the accounts of all 23 local government areas for the past three years. This decision is part of the state's response to the ongoing political crisis.

During the swearing-in of the new Caretaker Committee Chairmen for the Local Government Areas, Governor Fubara explained that the audit aims to provide a financial check for the incoming officials. He advised the caretaker chairmen to prioritize the interests of their communities and validate the government's decision to appoint them.

Fubara highlighted that the current situation reflects the democratic process. He stressed that the opposition to tenure extension is crucial not only for Rivers State but for the entire country, as it could set a precedent nationwide. He also noted that it is common for many states to be managed by caretaker committees.

The ceremony is taking place at the Government House in Port Harcourt under strict security measures. It was reported that the first 11 caretaker chairmen were being sworn in. This follows Fubara's submission of the nominees to the state House of Assembly, led by factional Speaker Victor Jumbo, the previous day. The nominees were called for screening early Wednesday morning.

This development adds complexity to the political tensions in the state following the passage of the Local Government Amendment Bill. Although Governor Fubara did not sign the bill, the Assembly, led by Martin Amaewhule, overrode his veto. The bill allows the Assembly to extend the tenure of council chairpersons, their deputies, and councillors if elections cannot be held before their terms end. However, the amended law was nullified by a court, leading to an appeal with a decision expected on June 20, 2024.

Amidst the ongoing conflict over the tenure extensions, leaders from Akuku-Toru and Asari-Toru LGAs have called for calm after youths blocked council secretariats. Meanwhile, some Ijaw youths showed their support for Fubara by gathering outside the Port Harcourt LGA Secretariat with placards, flags, and displays of solidarity.

The Rivers State Police Commissioner, Olatunji Disu, has urged politicians and their followers to remain peaceful and respect the legal process. He emphasized that the police are prepared to prevent any disturbances in the state.
