July 1, 2024 Kanu’s Case Dismissed Due to Insufficient Evidence of Rights Violation by Federal Government and DSS

A Federal High Court in Abuja has dismissed a ₦1 billion lawsuit filed by Nnamdi Kanu, the detained leader of the proscribed Indigenous People of Biafra (IPOB), against the Federal Government and the Department of State Services (DSS). Justice James Omotosho delivered the judgment, stating that Kanu did not provide credible evidence to support his claims of rights violations by the defendants.

The court ruled against Kanu's allegations that he was denied unrestricted access to his lawyers by DSS operatives and that his conversations with legal counsel were eavesdropped upon. Justice Omotosho concluded that these claims could not be substantiated.

NAN reported that Kanu, through his lawyer Aloy Ejimakor, had filed the lawsuit against the Federal Republic of Nigeria, the Attorney-General of the Federation, the DSS, and its Director-General. The lawsuit sought various declarations and injunctions, including recognition that the seizure and photocopying of confidential legal documents by the DSS constituted a breach of his rights.

In response, the DSS filed a counter affidavit denying the allegations. Yamuje Benye, a staff member of the DSS Legal Department, asserted that Kanu was securely held and not in solitary confinement. Benye stated that Kanu had regular access to his family and legal team during visiting hours without interference.

Benye refuted claims of document confiscation or interference with legal consultations, stating that DSS personnel adhered to standard security procedures during visits. He argued that Kanu's lawsuit amounted to an abuse of the court process, as similar issues were pending judgment before another court presided over by Justice Binta Nyako.

The Federal Republic of Nigeria and the Attorney-General of the Federation also supported the dismissal of the lawsuit, citing it as an abuse of court process.
