Controversial artist Abdulazeez Fashola, known as Naira Marley, and Lagos socialite Samson Eletu, also recognized as Sam Larry, have initiated a fundamental rights lawsuit challenging their prolonged incarceration in connection with the tragic demise of the 27-year-old singer Ilerioluwa Aloba, alias Mohbad.
In the case filed at the Federal High Court in Lagos, they have named the police and Lagos Magistrate Adeola Olatunbosun, who had sanctioned their detention in police custody for 21 days, as defendants. Naira Marley and Sam Larry seek N20 million each in damages from the defendants.
Their legal representation, Mr Olalekan Ojo (SAN), filed the suit, arguing that their detention since October 4, 2023, at the Homicide Section of the Lagos State Police Command in Panti, Yaba, Lagos State, violated their rights. They are urging the court to issue an order for their immediate release.
In their affidavits accompanying the lawsuits, deponents reveal that their legal predicament began between October 3 and 4, 2023, when they were apprehended by the police on allegations connecting them to the death of Ilerioluwa Aloba, also known as Mohbad. On October 4, 2023, the Commissioner of Police sought an order in the Magistrates' Court in Yaba to detain them for 30 days.
Chief Magistrate Adeola Olatunbosun granted the police's application for a 21-day remand. The 21-day remand order granted by Chief Magistrate Olatunbosun expired on October 26, 2023, and has not been renewed since.
