2023 Presidential Elections: Supreme Court Affirms Victory

Congratulatory messages continue to pour in for the president, the opposition Peoples Democratic Party (PDP) and the Labour party have expressed disappointment over the ruling of Supreme Court.

In a statement from its spokesman Debo Ologunagba the PDP said the verdict disappointed and “thrashed” the expectations of Nigerians.

The PDP accused the Supreme Court of condoning “serious issues of forgery, falsehood and perjury on the altar of technicalities, which has shaken the confidence of Nigerians in the judiciary.

It, however, urged “Nigerians not to be discouraged or allow the judgment to detract from their collective quest for the entrenchment of a credible electoral system.

The Labour Party on its part described the judgment as sad,.

National Chairman of the party, Julius Abure, while speaking at a press conference expressed surprised that the apex Court will toe the line of an earlier judgement in spite of all the what he described as flaws associated with the judgment delivered by the Presidential Election Appeal Tribunal.

He noted that despite the disappointment the party has chosen to trudge on and to remain optimistic of what the future holds for the nation.

Atiku Abubakar Urges Supreme Court To Admit Fresh Evidence In Tinubu Case

The presidential candidate of the People’s Democratic Party (PDP) in the February 25 presidential poll, Atiku Abubakar, has again asked the Supreme Court to scrap technicality and grant his application seeking to tender fresh evidence against President Bola Tinubu.

The former Vice President stated this in his reply on the point of law to Tinubu’s objection to granting leave for him to present the fresh evidence before the apex court.

Atiku predicated his plea because presenting forged documents by any candidate, especially one for the highest office in the land, is a grave constitutional issue that must not be encouraged.

President Tinubu had based his objection on the grounds of jurisdiction and that the qualification issue is a pre-election matter, amongst others and subsequently prayed the court to deny the grant of the application.

While faulting President Tinubu, Atiku submitted that issues of merit ought not to be determined or pronounced upon at the interlocutory stage.

The appellants note that they are only at this stage merely applying for leave of the Supreme Court to receive the fresh evidence, submitted that “to refuse to grant the leave as the respondents have argued, will amount to undue technicality.”

Atiku also faulted President Tinubu’s submission that he was inconsistent in his name, describing the submission as immaterial and pedestrian, as there is no petition challenging his qualification.

PDP BoT Confident Supreme Court Will Correct ‘Errors’ In Tribunal Verdict

The People’s Democratic Party (PDP) Board of Trustees (BoT) has said it believes the party will get justice at the Supreme Court against the judgment of the Presidential Election Petition Tribunal, which affirmed the victory of President Bola Tinubu in the February 25 election.

A week after the ruling, the PDP BoT rejected the verdict, saying it would resist alleged attempts by the APC to foist one-party rule on Nigerians.

In a communiqué after the 75th meeting of the Board in Abuja, the acting Chairman of the BoT, Senator Adolphus Wabara, expressed confidence in getting favorable judgment from the apex court.

Wabara, who is a former PDP National Chairman, equally said the party fears that Nigeria may be sliding into a one party state under the APC.

Supreme Court Fixes May 19th For President Buhari’s Suit Against National Assembly Over Section 84(12) Of Electoral Act

The Supreme Court has invited President Muhammadu Buhari to appear before it on Thursday, May 19th for a hearing in a suit he instituted against the National Assembly challenging Section 84 subsection 12 of the 2022 Electoral Act.

Also invited to be in court on the same day are the National Assembly and its leadership to defend various constitutional breaches raised against them by the Presidency.

A hearing notice issued by the apex court indicated that the invitation of President Buhari was served on him through his private lawyer, Prince Lateef Fagbemi.

By implication, Fagbemi, a Senior Advocate of Nigeria, is to profer arguments against the National Assembly on the invalidity and unconstitutionality of Section 84 (12) of the new Electoral Act.

The National Assembly had countered a suit filed by President Buhari and the Attorney-General of the Federation and Minister of Justice, Abubakar Malami, on the controversial Section 84 subsection 12.

While the President and minister asked the Supreme Court to interpret the provision of the section of the law, the lawmakers opposed the request to strike it out.

Their position was contained in a counter-affidavit filed by the counsel to the National Assembly, Kayode Ajulo at the apex court.

Speaking on a monitored programme, a Senior Advocate of Nigeria, Jibrin Okutekpa wondered what the grievance of President Buhari was, considering that he is not affected by the said section of the act.
